On August 12, 2024, V&A obtained a favorable opinion on summary judgment on behalf of Plaintiff Trustees of the Fulton Fish Market Pension Fund (the “Fund”). 

The action, styled Trustees of the Fulton Fish Market Pension Fund v. M. Slavin & Sons, Ltd. et al., 22 CV 00187 (JMF), United States District Court for the Southern District of New York, sought, inter alia, to recover withdrawal liability of $554,474 and related damages of $370,596.15 from M. Slavin & Sons, Ltd. and related successor entities, including Defendant Oceanbox Wholesale LLC.  On summary judgment, the Fund successfully demonstrated Oceanbox Wholesale LLC’s successor liability; the Court held that “Oceanbox plainly had notice of M. Slavin’s potential withdrawal liability” and “the totality of circumstances supports a findings of substantial continuity from M. Slavin to Oceanbox.”  Trs. of the Fulton Fish Mkt. Pension Fund v. M.
